Welcome to Otellux. These Terms of Service (“Terms”) govern your access to and use of the Otellux website, software, and related services (collectively, the “Service”).

By accessing or using Otellux, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Otellux

Otellux is a hotel management and booking platform that provides tools for hotel operations, reservations, payments, guest management, reporting, and communication.

2. Eligibility and Account Registration

  • You must be at least 18 years old to create an account on Otellux.

  • You agree to provide accurate, complete, and up-to-date information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are responsible for all activities that occur under your account.

Otellux reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Use of the Service

You agree to use Otellux only for lawful purposes and in compliance with all applicable Nigerian laws and regulations.

You must not:

  • Use the Service for fraudulent or illegal activities

  • Attempt to gain unauthorized access to the platform or its systems

  • Upload malicious code, malware, or harmful content

  • Interfere with the security or performance of the Service

  • Misuse guest or third-party personal data

4. Hotel and Business Responsibilities

If you use Otellux as a hotel or business operator, you are responsible for:

  • The accuracy of hotel listings, pricing, availability, and policies

  • Compliance with applicable hospitality, tax, and regulatory requirements

  • Lawful collection and use of guest data in line with the Nigeria Data Protection Act (NDPA)

  • Ensuring that content uploaded to the platform does not violate third-party rights

Otellux acts as a technology service provider and does not operate or manage hotels listed on the platform.

5. Payments and Transactions

Otellux integrates with third-party payment gateways to enable secure transactions.

  • Payment processing is handled directly by licensed payment providers.

  • Otellux does not store sensitive payment information such as card details.

  • Transaction fees, commissions, or service charges (where applicable) will be disclosed transparently.

  • Refunds, cancellations, and chargebacks are subject to the hotel’s policies and the payment provider’s rules.

Otellux is not liable for payment failures caused by banks, gateways, or third-party service providers.

6. Third-Party Services and Integrations

Otellux may integrate with third-party services including:

  • Payment gateways

  • SMS and communication providers

  • Analytics and security tools

Your use of these services may be subject to the third party’s own terms and policies. Otellux is not responsible for third-party services beyond its reasonable control.

7. Intellectual Property

All content, software, branding, logos, and design elements on Otellux are the intellectual property of Otellux or its licensors.

You may not:

  • Copy, modify, distribute, or resell any part of the Service

  • Use Otellux branding without prior written consent

A limited, non-exclusive, non-transferable license is granted to you to use the Service for its intended purpose.

8. Data Protection and Privacy

Otellux processes personal data in accordance with its Privacy Policy and the Nigeria Data Protection Act (NDPA) 2023.

By using the Service, you acknowledge that:

  • Personal data may be collected, processed, and stored as described in the Privacy Policy

  • You have read and understood the Privacy Policy available on our website

9. Service Availability and Modifications

Otellux strives to maintain high service availability but does not guarantee uninterrupted access.

We reserve the right to:

  • Modify, update, or discontinue features

  • Perform maintenance or upgrades

  • Suspend access for security or operational reasons

Where reasonably possible, advance notice will be provided.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Otellux shall not be liable for indirect, incidental, or consequential damages

  • Otellux is not responsible for losses arising from hotel operations, guest disputes, or third-party services

  • Use of the Service is at your own risk

Nothing in these Terms limits liability where such limitation is prohibited by Nigerian law.

11. Indemnification

You agree to indemnify and hold harmless Otellux, its directors, employees, and partners from any claims, damages, or losses arising from:

  • Your use of the Service

  • Violation of these Terms

  • Breach of applicable laws or third-party rights

12. Termination

Otellux may suspend or terminate your access to the Service if you:

  • Violate these Terms

  • Engage in unlawful or harmful activities

  • Misuse the platform or compromise security

You may stop using the Service at any time.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any disputes arising from these Terms or the use of Otellux shall be subject to the exclusive jurisdiction of Nigerian courts.

14. Changes to These Terms

Otellux may update these Terms from time to time. Updates will be published on this page with a revised effective date.

Continued use of the Service constitutes acceptance of the updated Terms.
